Governing the use of AetherFi's yield generation platform and services.

By accessing or using the AetherFi platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use our services. These Terms apply to all users, visitors, and account holders worldwide, and are structured to comply with applicable U.S. federal and state regulations, as well as international digital asset and e-commerce standards.

1. Eligibility & Account Registration

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally permitted to engage in digital asset transactions to use AetherFi. You agree to provide accurate, current, and complete information during registration and to promptly update it as necessary. Account sharing, credential selling, or use of automated scraping/bot tools is strictly prohibited.

2. Nature of Services & Yield Mechanics

AetherFi provides automated yield generation services by allocating deposited digital assets across vetted decentralized finance (DeFi) protocols, liquidity pools, and staking networks. Yield rates are estimates based on historical performance, market conditions, and protocol rewards. They are not guaranteed, fixed, or interest-bearing in the traditional banking sense. Yields fluctuate based on network activity, smart contract performance, and macroeconomic factors.

3. Deposits, Withdrawals & Fees

Users retain beneficial ownership of deposited assets. AetherFi operates a performance-fee model, charging a transparent fee (typically 10% of net yield generated) only on realized profits. Deposits and withdrawals incur zero platform fees, though standard blockchain network gas fees may apply. Withdrawal processing times depend on blockchain confirmation speeds and may be temporarily delayed during network congestion or security reviews.

By using AetherFi, you acknowledge these risks and agree that AetherFi is not liable for losses arising from market movements, protocol failures, or force majeure events, except where gross negligence or willful misconduct by AetherFi is legally proven.

5. Prohibited Conduct

You agree not to use the Platform for money laundering, terrorist financing, sanctions evasion, fraud, market manipulation, or any illegal activity under U.S. or international law. AetherFi reserves the right to freeze, suspend, or terminate accounts suspected of violating these Terms or applicable regulations, with or without notice.

6. Intellectual Property

All Platform content, branding, algorithms, interfaces, and documentation are the exclusive property of AetherFi or its licensors. Unauthorized reproduction, modification, reverse engineering, or commercial exploitation is prohibited. Users retain ownership of their deposited assets and transaction data.

7. Limitation of Liability

To the maximum extent permitted by law, AetherFi, its directors, employees, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of profits, data, or yield opportunities. Our total aggregate liability shall not exceed the amount of fees you paid to AetherFi in the 12 months preceding the claim.

8. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall first be submitted to confidential mediation. If unresolved, disputes will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Users waive rights to jury trials and class actions to the fullest extent permitted by law. Nothing herein limits mandatory consumer protection rights under applicable local or international law.

9. Electronic Communications & Consent

By using AetherFi, you consent to receive communications electronically via email, dashboard notifications, or SMS. You agree that electronic signatures, records, and notices satisfy legal writing requirements under U.S. ESIGN/UETA Acts and equivalent international e-commerce legislation.

10. Modifications to Terms

We may update these Terms to reflect regulatory changes, platform upgrades, or operational improvements. Material changes will be posted with a revised "Last Updated" date and communicated via email or in-platform notice. Continued use after the effective date constitutes acceptance of the updated Terms.
